Petition for Expunction
An Expunction is the process in North Carolina that allows certain charges to be removed from one’s ‘record.’
It is important to note that not all matters can be expunged. Typically, criminal convictions that are from offenses after reaching the age of 18 CANNOT be expunged. However, there are some exceptions.
There are many different types of Expunctions and often times the different rules can be rather complex.
I have handled Expunctions as part of my practice since 2008. In those years, I have successfully processed many Expunction Petitions. I have also seen a few times where a person seeking an Expunction hires the attorney that quotes the lowest price. When I see this, the concept “you get what you pay for” comes to mind. Sometimes the person has ended up regretting their decision to save a few dollars after their Expunction Petition was not submitted successfully and now some charges that could have been expunged will remain on that person’s record.
I have given presentations to other lawyers throughout the State on the Expunction process. I have also counseled many younger attorneys in Mecklenburg County’s courthouse on the do’s and don’ts of Expunctions.
